1. Acceptance Of These Terms

Where a conflict exists between these terms and a written service agreement signed by the community, the signed service agreement governs that service.

2. Eligibility To Use The Website

This website is intended for adults who are at least eighteen years of age and who are capable of entering into a binding agreement. A person who uses the website on behalf of a household or an organization confirms that they are authorized to do so. The website is not directed at children, and the community does not knowingly accept submissions from a child. A parent or guardian who believes a child has submitted information through the website should contact the resident services team so that the information can be removed.

3. Scope Of Services

The community provides residential apartment housing and the services that support it. Those services include apartment leasing and tours, resident services, maintenance coordination, amenity management, lease renewals and transfers, and community events. 4. Leasing And Tours

Tours are offered by appointment and on a published schedule, subject to the availability of staff and the condition of the homes shown. A tour does not reserve a home and does not create a tenancy. Information shared during a tour, including information about floor bands, views, amenities and timing, is provided in good faith but may change as the community operates.

A prospective resident who wishes to proceed will be invited to submit an application. Until an application is approved and a lease is signed, no home is held and no rate is locked. The community may pause or end a leasing conversation if a person behaves in a way that is unsafe, abusive or unlawful toward staff or other residents.

5. Applications And Screening

Applications are reviewed against written criteria that are applied consistently to all applicants in accordance with fair housing law. The review may consider identity, income, employment, rental history, credit information and the outcome of a consumer report where one is lawfully obtained. An applicant is responsible for providing accurate and complete information and for informing the community promptly if something changes.

Providing false, misleading or incomplete information may result in denial of an application or, where a tenancy has begun, may be treated as a breach of the lease. An applicant who is not approved may request information about the basis of the decision where the law provides that right. Any application fee that applies will be disclosed before the application is submitted.

6. Lease Agreement Controls Tenancy

The rights and obligations of a resident arise from the signed lease agreement, the community rules that are incorporated into it and the law that governs residential tenancy. Conduct that creates unreasonable noise, damages property, creates a safety hazard, harasses another person or violates the law is not permitted in the community or in any shared space.

The community will respond to a reported disturbance in a proportionate manner, beginning with a reminder where appropriate and escalating where a pattern continues or where a situation is serious. 10. Use Of Amenities And Shared Spaces

Amenities and shared spaces are provided for the use and enjoyment of residents and their guests, subject to the amenity rules. 24. Governing Law And Severability

These terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to conflict of law principles. Where a dispute is subject to the jurisdiction of a court, the parties consent to the jurisdiction and venue of the courts that serve Salt Lake County, Utah, unless a different forum is required by law.

If a provision of these terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

25. Changes To These Terms

These terms may be updated from time to time to reflect changes in the law, in the services offered or in the operation of the community.
